Please note Final Rules and Regulations recently released. You will find language of the regulations very similar to the language being discussed around New York such as defining personal outcome measures as the indicator of choice not so much as defining a type of residence or workplace.  Also, they further mandate person centered planning. This final rule amends the Medicaid regulations to define and describe state plan section 1915(i) home and community-based services (HCBS) under the Social Security Act (the Act) amended by the Affordable Care Act.

As a result, states will be able to design and tailor Medicaid services to better accommodate individual needs.
